We are trying going to make an online and open commentary on the law of Arbitration in India. We will primarily focus on the Arbitration and Conciliation Act of 1996, India. We will also attempt to analyze the Arbitration Act of 1940, to appreciate the history of Arbitration law. As and where needed, we will also appreciate and analyze similar provisions of the Arbitration Acts of the UK and USA.
But wait! There's more! 😋
We will also analyze any analogous provisions present in the UNCITRAL Model Arbitration Law and also of the rules of Institutional Arbitration Centres like the ICC, London International Arbitration Centre, SIAC, etc.
The objective is to basically make this blog the starting point of legal research for Arbitration and Arbitration Litigation in India. We want to dethrone paper commentaries. Mostly because we are jealous and can't afford them.
We will not make this blog password protected. It will always be freely accessible.
We will do this because we want to give back to the legal community and make law accessible. I may be stupid, but still, it does not make sense to me why I should spend thousands of Rupees on commentaries when I can write my own.
The way we will go about writing this commentary is -

The way we will go about writing this commentary is -
- We will first analyze the relevant statutory provisions and show you the legislative history relating to the provision in one post. The basic aim is to give you context and background about a given section.
- We will then analyze the various orders and judgments of the High Courts and the Supreme Court on the Section in question. So, in essence, our next post will be an analysis of the correct position of the law in different Jurisdictions.
- Next, we will write a post on the position of the law based on a given set of facts. Basically, this is what commentaries are used for my litigators- to find authorities to argue their submissions based on a given factual matrix.
All of this will take time, so please bear with us. If you are interested in being a part of this endeavor, drop us an email at FPKaizen@gmail.com. You won't receive any remuneration. You won't receive any certificates. You will, at most, have your name mentioned as the author. It won't be fun. But we may be able to provide you with access to legal research databases like casemine.com and lawfinderlive.com.
Casemine and Chawla Publications (the parent company of Lawfinderlive.com) have graciously agreed to sponsor us. So, special thanks to them, especially Mr. Bhagatjeet Singh, the Director of Chawla Publications.
